Time Constraints: A Iowa Preliminary Notice is required only:

Contractor: If you are doing work for the owner of a owner-occupied dwelling. You may serve said notice at anytime, but your lien shall be valid only to the extent of the remaining balance due the prime contractor at the time of the service of your notice;

Material men: If you supply materials to a sub-contractor who only furnishes materials. Said notice must be served by certified mail or personal service within 30 days of furnishing labor, materials or services.

Subcontractors are not required to furnish notice.

If the notice is required, and you file a lien, you must submit a copy of this notice along with your lien filing.

We strongly urge that you serve notice on all jobs in all cases. You may only lien for the unpaid portion of a contract, so having the owner thinking in terms of paying you may be a big help in your collection efforts.

Information Requirements: The information required by the program and whether you intend to send an owner cover letter.

Form Types: Preliminary Notice for Furnishing Labor, Materials or Equipment, Exhibits A-D (if needed) and the Owner Letter (if used).

Procedures: Enter the program data, including Additional Legal Parties or Releases for Other Companies. Where required, serve a copy on the prime contractor within 30 days of furnishing. IMPORTANT: In many cases Material men performing no job site labor and selling directly to a subcontractor may not been titled to a claim on the payment bond under Iowa law.

TIME CONSTRAINTS: Send copies of the notice to the prime contractors and public entities within 30 days of furnishing labor, materials or services. Where possible, obtain a copy of the payment bond information.
