Time Constraints: A Iowa Preliminary Notice is
required only:
Contractor: If you are doing work for the owner
of a owner-occupied dwelling. You may serve said notice at anytime,
but your lien shall be valid only to the extent of the remaining
balance due the prime contractor at the time of the service
of your notice;
Material men: If you supply materials to a sub-contractor
who only furnishes materials. Said notice must be served by
certified mail or personal service within 30 days of furnishing
labor, materials or services.
Subcontractors are not required to furnish notice.
If the notice is required, and you file a lien,
you must submit a copy of this notice along with your lien filing.
We strongly urge that you serve notice on all
jobs in all cases. You may only lien for the unpaid portion
of a contract, so having the owner thinking in terms of paying
you may be a big help in your collection efforts.
