Time Constraints: While called a Notice of Intent
to Lien (Lien Warning notice), the Kentucky form acts like a
preliminary notice of furnishing. All jobs require notice, but
when notice is actually required depends on the type of owner:
Owner Occupied Single or Family Dwelling: Notice
of Intent must be served by certified mail or personal service
on the owners within 45 days of last furnishing labor, materials
or services unless the contract was directly with the owner
or his authorized agent. In the latter case, notice is not required.
Otherwise: Notice of Intent must be served by
certified mail or personal service on the owners within 75 days
on claims less than $1,000.00, or 120 days on claims in excess
of$1,000.00, of the last furnishing of labor, materials or services
unless the contract is directly with the owner or his authorized
agent. In the latter case, notice is not required.
However, it is our strong recommendation that
you serve notice on all jobs and within the time frame demanded
by the owner occupied job. This will prevent any errors since
the most restrictive conditions listed under the law will be
met.

you need, the information required by the program and whether
you intend to send an owner cover letter.
Form Types: Notice to Owner of Intent to Lien,
Exhibits A-D (if needed), and the Owner Letter (if used).
Procedures: Enter the program data, including

a copy on the owners within the time frames described above.
Service on prime contractors, lenders, sureties and your customer

Scope: State of Kentucky, Public Works, All Public
Claims
Important: Kentucky provides for two type of claims
against public works depending if the property is privately
or publicly held. This form may be suited to establish your
claim in either case, but be sure to follow the correct proceeds
for filing of your lien and bond claims. See the Kentucky Bond
or Lien Claim, Public Work, memos for the appropriate action.
Time Constraints: To properly reserve a lien on state funds,
a Kentucky Statement of Furnishing must be filed with the County
Clerk's office before or immediately after the first furnishing
of labor, materials or services. A copy of the Statement of
Furnishing attested by the Clerk's Office must be then immediately
served by certified mail or personal service on the owner or
owner's authorized agent.
Payment Bond: Recovery on payment bonds is not
covered by Kentucky statutes. You will have to obtain a copy
of the bond, if any, to find its terms and conditions. The Statement
of Furnishing will request this information.

the project is located. Copies of all of the attested (that
is, stated with the County Clerk's stamp) forms (less the Owner
Cover Letter and the Recorder Letter) must be sent to all public

all sureties or your customer is optional.
