Scope: State of Missouri, Private Works
Time Constraints: The type of preliminary notice
you use for Missouri private works depends on the type of work
you are doing:
Residential Work: If you are furnishing labor, materials or
services to a residential property, (unless you are the original
contractor,) you must obtain the consent of the owner to lien
his property in the event of non-payment before you supply your
services. Serve the notice by certified mail or personal service
on the owners and include a copy of the Notice to Owner of Intent
to Lien for signature and an envelope for return to you. If
this agreement is not signed you cannot claim a lien.
Commercial Work: Serve a copy of the Notice to
Owner of Intent to Lien by certified mail or personal service
on the owners, prime contractors, lenders and sureties before
the first furnishing of your labor, materials or services.
In either case, you must still serve a Lien Warning
Notice before you have a right to claim a lien. See

Form Types: Notice of Intent to Lien, Exhibits
A-D (if needed), and the Owner Letter (if used).
Procedures: Enter the program data, including Additional Legal
Parties or Releases for Other Companies. Serve a copy on the
owners, prime contractors, lenders and sureties within the time
frames described above. For residential owners include an additional
copy and return envelope.
When in doubt, file your lien claim immediately.

Labor, Materials or Equipment and Request for Copy of Public
Bond.
Scope: State of Missouri, Public Works.
Time Constraints: Missouri has no requirements
as to statutory provisions for bond claims. However, Missouri
courts have continually upheld notice requirements included
in the terms of the Payment Bond. Send the Notice of Right to
Lien to (hopefully) obtain information as to the bond requirements,
if the bonding company is not known, and then also serve a Notice
of Right to Lien on the bonding company, too.
Payment Bond: Recovery on payment bonds is not
covered by Missouri statutes. You will have to obtain a copy
of the bond, if any, to find its terms and conditions.
