Time Constraints: A Notice to Owner of Materials
Supplied or Work or Services Performed must be prepared and
served on the owners, general contractors, customers and lenders
(and sureties, if one exists) by personal service or certified
mail no later than 31 days after first furnishing of labor,
materials or service. Failure to prepare and serve this notice
will eliminate your future rights to lien.
Prime or General Contractors, or other persons
contracting directly with the owner, must prepare and send the
similar Contractor’s Notice to Owner for General Contractors.
For this notice to print instead of the Notice to Owner of Materials
or Work or Services notice you must check the General Contractor
box in your company setup (Program main menu bar, then Company
Entry Update, then locate your company, then check the General
Contractor box).
Information Requirements: The information required
by program and whether you intend to send an owner cover letter.
Form Types: Notice to Owner of Materials Supplied
or Work or Services Performed (Private Work), Exhibits A-D (if
needed)and Owner Letter (if used).
Procedures: Enter the program data, including
Additional Legal Parties or Releases for Other Companies. Copies
of all of the forms (less the Owner Cover Letter) must be sent
to all legal owners, all general contractors, all lenders and
all sureties. Sending a copy to your customer is optional(unless
they ARE the owners, general contractors, lenders or sureties).
When in doubt, file your lien claim immediately.
Important: If you fail to prepare and serve your
Preliminary Notice within the 31 days after first furnishing
of labor, materials or service, this does not have to mean that
you have to lose all of your lien rights. The service of the
Preliminary Notice becomes effective at the date of service
minus 31 days before, so if you file on the 31stday, you actually
lose your lien rights only for the 1stday. In any case, even
if you are late, serve your preliminary notices. The owners
may require that they are honored in any case.
